A charterer / passenger is any person who is aboard a yacht operated by Monsoon Safaris.
Charter prices and schedules refer to information currently posted at Monsoon Safaris' website www.monsoonsafaris.com.
SCOPE OF RESPONSIBILITY:
Monsoon Safaris' responsibility extends only from embarkation to disembarkation at the beginning and end of each charter. Monsoon Safaris reserves the right to change these Terms & Conditions at any time without notice.
PAYMENTS:
Balance payments should be received 30 days prior to departure. If the reservation is made less than 30 days before departure, a full payment must be made at the time of booking.
1 - DEFINITIONS:
1.1 Adult: Any person who has reached their 13th birthday will be considered an adult.
1.2 Infant: Any person who is 5 years of age or less.
1.3 Child: Any person that is between his or her 6th and 12th birthday will be classed as a child.
1.4 Currency: All charges noted on Monsoon Safaris website and in Monsoon Safaris' brochures, will be, as indicated, in US$ (cash or credit card) unless otherwise noted.
1.5 Schedules: Monsoon Safari reserves the right to change or alter the schedule to meet traffic demands.
2 - CONTRACT VALIDITY AND TIME LIMITS:
2.1 Monsoon Safaris reserves the right to establish advance booking purchase time limits. Monsoon Safaris reserves the right to automatically cancel any reservation that has not met the advance booking purchase time limit.
2.2 Monsoon Safaris reserves the right to collect a surcharge on the price paid if an increase has occurred prior to the commencement of travel.
2.3 The yacht charter is valid only for the date and time shown on the contract.
2.4 All yacht charters are return trips, whether such trips are purchased separately or together with other services.
2.5 Monsoon Safaris reserves the right to refuse to accept any yacht charter contract that has been mutilated, lost, or stolen. A charter contract is considered valid only after it has been properly endorsed by Monsoon Safaris.
2.6 Monsoon Safaris shall not be liable in the event of a contract loss, destruction, or theft, or if the contract is honored for transportation or refund when presented by any other person.
2.7 Yacht charters are only valid for travel during the year that it is purchased. Monsoon Safaris reserves the right to refuse cash or credit card refunds on any purchase.
2.8 Monsoon Safaris will hold a credit for future travel for the amount of the unused reservation.
2.9 The charterer will contact the Reservations Department and identify himself including the booking number of the unused yacht charter contract to use the credit being held in the reservations system.
3 - PASSENGER REQUIREMENTS:
3.1 All passengers are required to have a valid passport, visa and other travel documents.
3.2 Monsoon Safaris cannot be held responsible in the event that authorities prevent a passenger from continuing his / her journey.
3.3 Monsoon Safaris reserves the right to deny embarkation to any individual who does not possess valid travel documents.
3.4 In the event of a fine being imposed on Monsoon Safaris by the authorities, the amount will be charged to the passenger who failed to provide the proper legal documents.
3.5 In the event of immigration officials refusing entry, the charterer / passenger will be sent back at his own expense.
3.6 Infants and children also require an official form of identification.
3.7 All passengers and luggage are subject to security search prior to boarding and boarding the boat and / or anytime while onboard the boat by the authorities (Coast Guard).
4 - ACCEPTANCE / NON-ACCEPTANCE OF PERSONS AND GOODS:
4.1 Monsoon Safaris reserves the right to refuse passage to any person or luggage.
4.2 Pets: Pets are not allowed aboard our yacht charters.
4.3 Firearms and Other Dangerous Goods: Monsoon Safaris will not accept for carriage firearms, ammunition, explosives, or any other form of goods considered dangerous. Any items confiscated by Customs may not be returned.
4.4 Wheelchair Passengers: Monsoon Safaris cannot accept wheelchair passengers due to the physical restraints on the vessel, we are however willing to accept passengers with physical disabilities, but only after prior consultation with Monsoon Safaris with regard to how we can accommodate the passengers needs and with agreement of all parties, including the skippers agreement.

5 - OPERATION OF THE YACHT:
5.1 Monsoon Safaris will not accept any liability arising from an alteration in the published schedule or route.
5.2 Monsoon Safaris does not guarantee that the service shall start or arrive at the time stated in the charter contract and will not be liable for any additional costs incurred by the passenger as a result of any delay.
5.3 Monsoon Safaris may cancel any operation without liability if in its opinion the safety of the passengers, crew, or boat could be in danger or for any other reason in Monsoon Safaris' sole and absolute discretion.
5.4 The liability of Monsoon Safaris if any will cease when passengers are landed at any port. Monsoon Safaris reserves the right to substitute a boat or cancel any operation entirely if it becomes necessary for any reason.
5.5 Monsoon Safaris reserves the right to land at intermediate ports and / or ports beyond destination or to divert to alternate ports for safety and / or rescue purposes or such other purpose as may reasonably be determined by Monsoon Safaris.
5.6 Monsoon Safaris may conclude the voyage at such ports without additional compensation to the charterer / passengers.
6 - CANCELLATION AND DELAY POLICIES:
6.1 If the yacht charter is cancelled or delayed, Monsoon Safaris will not be responsible for additional expenses incurred such as travel, transportation, hotel, food or any other additional expenses.
6.2 If the passenger chooses alternate transportation and accommodation he or she has the option to be fully refunded for that unused portion of the ticket or exchange it for a different trip.
6.3 The unused contract must be presented for a refund. Monsoon Safaris reserves the right to change its schedule, prices or route at any time and does not accept any liability arising from an alteration in the published schedule, prices or route or pay for any additional costs which may be incurred by its passengers.
6.4 Monsoon Safaris reserves the right to land at alternate ports for safety and / or rescue purposes or such other purpose as may reasonably be determined by Monsoon Safaris.
6.5 Charterer yacht charter cancellation: INITIAL PAYMENT (25% DEPOSIT) IS NON-REFUNDABLE.
6.6 Charterer / Passengers who need to make changes to their reservations must do so as early as possible.
6.7 Cancellation fees are agreed to be liquidated damages and are not considered a penalty.
Cancellation 99 days or more before departure then 25% is retained.
Cancellation 98-60 days before departure then 30% is retained.
Cancellation 59-30 days before departure then 50% is retained.
Cancellation 29-0 days before departure then 100% is retained.
6.8 All purchases are valid for any yacht charter departure on a stand-by basis.
6.9 Company Yacht Charter Cancellation: Monsoon Safaris at its sole and absolute discretion reserves the right to cancel any scheduled trip and / or substitute a boat without liability if it becomes necessary for any reason.
6.10 Monsoon Safaris does not guarantee that the service shall depart or arrive at the time stated in the charter contract and will not be liable for any additional travel costs incurred by the passenger as a result of any cancellation.
6.11 If the yacht charter is cancelled for any reason, Monsoon Safaris Policy is as follows:
Charterer / passengers who have not yet departed will be offered either a full refund or the contract can be exchanged for a different time.
6.12 Company Yacht Charter Delays: Monsoon Safaris does not guarantee the trip will take the time mentioned on the website or brochure and crossing times may vary due to weather, tides, sea conditions or mechanical issues.
6.13 Monsoon Safaris can not be held liable for delays of the yacht charter due to any unforeseen circumstances such as weather, tides, sea conditions or mechanical issues.
6.14 Monsoon Safaris does not guarantee that the service shall depart or arrive at the time stated in the schedule and will not be liable for any additional travel costs incurred by the passenger as a result of any delay.
7 - BAGGAGE ALLOWANCE:
7.1 Each adult fare passenger will be allowed one carry on a personal carry-on item such as a briefcase, laptop or personal bag and two pieces of luggage free of charge.
7.2 The passenger may substitute fishing or golfing equipment for one piece of luggage.
7.3 You will be required to carry on your own luggage and place it in the luggage area.
7.4 Monsoon Safaris is not liable for loss or damage to passengers' baggage or property.
8 - BAGGAGE ACCEPTANCE
8.1 Monsoon Safaris can refuse to carry any article that Monsoon Safaris, in its sole judgment, considers harmful or dangerous to the boat, passengers, crew, or other goods being transported. Monsoon Safaris is not liable for loss or damage to passengers baggage or property.
9 - SECURITY INSPECTIONS:
9.1 All passengers, personal items, luggage and freight may be subject to search and inspection prior to boarding our boat and / or anytime while on board our boat by authorities such as coast guard.
10 - INCLUDED SERVICES:
10.1 Prices include yacht charter as specified in the pricelist / itineraries and applicable taxes and fees. Prices do not include (without limitation) insurance of all kinds; phone calls; beverages; meals not detailed in the itinerary; gratuities to taxi, courtesy van, or tour drivers; items of a personal nature; excess baggage; optional excursions; or any other service.
10.2 The yacht and its equipment are comprehensively insured under a policy covering Monsoon Safaris for the full value thereof and not less than £1 000 000 sterling third party cover for the skipper and crew in case of gross negligence or fault. Monsoon Safaris shall not be liable for any loss which you or any member of the charter party may suffer or incur as a result of the insurers’ refusal to indemnify any claimant as a consequence of his own fault or contributory negligence.
11 - PASSENGER CONSENT:
11.1 The passenger acknowledges that it has been provided by Monsoon Safaris with the opportunity to review Monsoon Safaris' Terms and Conditions, by way of notice on Monsoon Safaris' website.
12 - COMPLAINTS:
12.1 The Monsoon Safaris Management hopes you have a trouble free and enjoyable holiday, but recognises that things can and do occasionally go wrong.
12.2 In the unlikely event that you and cause to complain about your yacht charter, or any other service provided during your yacht charter, the following procedure must apply:
12.3 In order for the problem to be resolved on the spot, the complaint MUST IMMEDIATELY be brought to the attention of the captain or management of Monsoon Safaris.
12.4 Unless a complaint has first been brought to the attention of the management after the yacht charter has been completed, Monsoon Safaris will not carry out a full investigation nor consider any possible relocation.
12.5 If the captain is unable to resolve the problem to your satisfaction, and you choose not to continue your yacht charter, Monsoon Safaris will endeavour, but cannot guarantee, to provide alternative transportation and accommodation or, as the case may be, alternative activity.
12.6 You could, however, be liable for payment in full for the new booking.
12.7 Monsoon Safaris reserves the right to reject complaints.
12.8 For any complaints after the yacht charter has been completed no refund will be made.
13 - PERSONAL INJURY AND DEATH:
13.1 Clients bookings are accepted on the understanding that the clients appreciate the possible risks inherent in travel, and in particular adventurous activities such as trekking, climbing, walking safaris, game driving and diving.
13.2 Monsoon Safaris is not liable for any personal injury or death.
14 - SEVERABILITY:
14.1 Any provision herein which shall be found to be invalid or unenforceable shall be considered null and void but only to that extent and the remainder of these terms and conditions shall stand as valid and enforceable.
